The petitioner is languishing in custody since 13.07.2014 in a case registered for the offences punishable under Sections 302 and 379/34 of the Indian Penal Code. It is alleged that the informant was informed that her mother has been killed, but from the place of occurrence two mobiles of the victim were found missing, the same was recovered from the petitioner being used by inserting the sim registered in the name of the petitioner.
It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and recovery of mobile does not suggest that the petitioner
Patna High Court Cr.Misc. No.41591 of 2014 (03) dt.27-01-2015 2/2 participated in the commission of offence by committing murder of informant's mother.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Lakhisarai in connection with Piri Bazar P.S.
