The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case No. 429 of 2021 registered under Sections 302, 201, 120B and 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the name of the petitioner has been transpired in this case merely on suspicion. It is also submitted that the first information report has been lodged after two days. The petitioner has got no criminal antecedent.

Having considered the facts and circumstances of the

No.46899 of 2022(6) dt.16-05-2023 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Additional Chief Judicial MagistrateII, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 429 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
