JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Maner P.S. Case No.507 of 2016 registered under Sections 420, 406, 504 and 506 of the Indian Penal Code.
Allegation against the petitioner is that he had taken the cattle feeds on different dates in total worth Rs.6,88,505/- but he is not making payment despite persuasion.
Learned counsel for the petitioner submits that the petitioner had business transaction with the informant and he used to purchase cattle feeds but petitioner refused to receive some damaged and expired cattle feeds and on this account this case was lodged.
Having considered the said facts and circumstances
Patna High Court Cr.Misc. No.30472 of 2017 (2) dt.06-07-2017 2 / 2 as the dispute primarily appears civil in nature so in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, Praveen Kumar @ Praveen Kumar Singh, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur, District Patna, in connection with Maner P.S. Case No.507 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
