ABHISHEK REDDY ORAL ORDER 13-11-2025 Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of admission with the consent of both the parties.

Having regard to the fact that the petitioner is only seeking disposal of the Encroachment Appeal No. 02 of 2022 pending before the Respondent No. 2, i.e, the Collector-cumDistrict Magistrate, Saharsa as expeditiously as possibly. The present writ petition is disposed of directing the Respondent No. 2, i.e, the Collector-cum-District Magistrate, Saharsa to pass necessary orders in the said Encroachment Appeal No. 02 of 2022 strictly in accordance with law as expeditiously as possible preferably within a period of 12 weeks from the date of receipt

3. It is needless to mention that before passing any order the petitioner as well as any other interested party shall be put on notice and given an opportunity of hearing. Any order passed shall be communicated to the party. In case any I.A. is filed by the petitioner seeking stay of the impugned order in the appeal the same shall be considered and necessary orders passed by the Respondent No. 2, i.e, the Collector-cum-District Magistrate, Saharsa.

4. With the above directions, the present writ petition stands disposed of.
