The petitioner has prayed for bail in a case registered for the offence punishable under sections 25(1-b)a, 26 of the Arms Act.
As per allegation in the FIR, on getting secret information about gathering of antisocial persons, patrolling party proceeded there and on seeing them 10-12 persons started fleeing away. On chase, two of them were arrested including the petitioner and on search a country made loaded pistol, a live cartridge were recovered from the waist of the petitioner. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Police
Patna High Court CR. MISC. No.46674 of 2022(5) dt.27-02-2023 2/2 took signature of the petitioner on blank paper which was later on manufactured as seizure list. There is no independent witness of the seizure list rather all the witnesses are police personnel. Petitioner is languishing in judicial custody since 4.4.2022. The application for bail is opposed by learned APP for the State and submitted that petitioner is having three criminal antecedents.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM X, Patna in connection with Patliputra P.S. Case No. 187 of 2022.
