Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in a case registered for the offence punishable under sections 366, 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the victim in her statement recorded u/s 164 Cr.P.C. has stated her age as 17 years and 9 months. She has further stated that she left the house and went to Jhanjharpur and then Delhi at her own sweet will. She has further stated that she is in love with the petitioner for last three years. She called the petitioner at Delhi and married him in the temple. Medical Board vide report dated 5.2.2020

Patna High Court CR. MISC. No.2955 of 2021(2) dt.12-03-2021 2/2 (Annexure 3) has found her major carrying three months pregnancy. Petitioner is in custody since 5.9.2020. Considering the aforesaid statement of the victim, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Jhanjharpur, Madhubani in Rudrapur Police Station Case No. 103/2019 on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
