17-08-2015 At the very outset, an objection was raised by learned State counsel that against the order impugned, the petitioner was having statutory remedy to approach the Civil Court instead of approaching this Court invoking its writ jurisdiction. After objection being raised, Sri Bajrangi Lal, learned counsel, who was assisted by Sri Rakesh Kumar, learned counsel for the petitioner makes a prayer for disposal of the writ petition so that petitioner may avail appropriate remedy. The prayer is allowed.

The writ petition stands disposed of with liberty, as indicated above.

It goes without saying that the period consumed by

Patna High Court CWJC No.21812 of 2013 (3) dt.17-08-2015 2/2 the petitioner in pursuing the present writ petition i.e. from 28-10-2013 till date shall be excluded while considering the limitation matter.
