The petitioner apprehends his arrest in Marhowrrah P.S. Case No. 436/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The allegation against the petitioner is that the petitioner assaulted the informant (lady) with Daab on her head. Learned counsel for the petitioner submits that the petitioner is co-sharer and on account of land dispute, the occurrence took place, but it appears that the petitioner assaulted a lady (informant) with Daab on her head and the corresponding injuries were found on the head of the informant Babita Devi. The injuries are simple in nature, but it was found scalp deep. Considering the facts aforesaid, I am not inclined to
