The petitioner seeks bail in a case for the offence punishable under Section 395 of the Indian Penal Code. The prosecution case is that a dacoity was committed in which the tractor of the informant was taken away. An F.I.R. has been lodged against five accused persons to have stolen the tractor of the informant. During investigation the name of the petitioner has appeared in the confessional statement of the co-accused Amar Kumar. Thereafter, the key of the tractor has been recovered from the possession of the petitioner.
It is submitted that the petitioner has no criminal antecedent. The named accused Bittu Kumar has been granted bail vide Cr. Misc. no. 46791 of 2014 and the petitioner has been in custody since 26.7.2014. Considering the facts and circumstances of this

No.40647 of 2014 (3) dt.10-02-2015 2/2 case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in Kahalgaon P. S. Case no. 353 of 2014 with the following conditions :
1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
