JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 19-08-2015 The petitioner was earlier granted PDS licence bearing Licence no.12 of 2008 within Laxmipur Cherapatti, block Rupauli under Purnea district. On complaint of respondent no.4 that the petitioner was running a flour mill, his PDS licence was cancelled.

Learned counsel for the petitioner submits that the flour mill did not belong to him and it was closed much prior to filing of the complaint by respondent no.4. He submits that in any view of the matter, still there is one PDS dealership vacancy in the said Panchayat. The petitioner, in support of his submission, has annexed a copy of letter of the SDO.

The writ petition is disposed of with a direction to the Licencing authority/District Selection Committee to consider

Patna High Court CWJC No.11385 of 2013 (3) dt.19-08-2015 the case of the petitioner for grant of licence against the said vacancy within four months.
