JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Hilsa P.S. Case No. 117 of 2019 registered for the offences punishable under Sections 341, 323, 354, 307, 379, 504, 447, 506, 509/34 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution story disclosed that petitioner assaulted the informant by putting pistol on her head and sat on her chest. Submission of learned counsel for the petitioner is that FIR itself disclosed that no injury was caused to the informant and petitioner has no criminal antecedent and furthermore the occurrence took place due to scuffle between the children of both the parties.

In view of above facts and circumstances, let
Patna High Court CR. MISC. No.42679 of 2019(2) dt.10-07-2019 2/2 petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nalanda at Biharsharif, in connection with Hilsa P.S. Case No. 117 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
