Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Jankinagar Police Station Case No. 97 of 2020 registered for the offences punishable under sections 307/34 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner and his family members went to the field of the informant and objected him from doing plantation work and on protest, petitioner is alleged to have assaulted the son of the informant with farsa as a result of which he sustained injuries on his ears and legs. Other accused persons also assaulted the victim.

Learned counsel for the petitioner submits that there is no allegation that the petitioner gave fatal blow to the victim as such offence under section 307 IPC is not attracted against him. Petitioner has got no criminal antecedent and there is land dispute between the parties. Petitioner is in custody since 8.8.2020.

Learned counsel for the State opposes the prayer for bail and submits that there is allegation against the petitioner that he assaulted the victim with farsa as a result of which he sustained injuries on his both legs.
