Petitioner apprehends his arrest in Sadar (Mofassil) P.S. Case No.57 of 2018, registered under Sections 147, 148, 149, 323, 332, 337, 427, 353, 504 and 506 of the Indian Penal Code.
The informant, a police official, alleged that on account of road accident, one motorcyclist got serious injuries and died during the course of treatment. On account of such accident, Pappu Goswami and his supporters blocked the road and assaulted the passers by. They also damaged the vehicles. Learned counsel for the petitioner submits that petitioner is of course named in the FIR but petitioner did not assault anybody nor damaged any vehicle. Taking into consideration the facts aforesaid and the fact that similarly situated accused persons including Pappu Goswami has already been enlarged on anticipatory bail, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea in connection with Sadar (Mofassil) P.S. Case No.57 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
