JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-08-2015 The case of the petitioner for grant of freedom fighter pension was forwarded to the State Government on the recommendation of State Advisory Committee. The petitioner has annexed the Extract Form of the Crime Index of G.R. No. 737/1942 from which it appears that the name of the petitioner figured at sl. No. 28 and the Special Judge, Dharbangha by order dated 09.05.1944 declared him as absconder. The petitioner remained underground from August, 1942 to May, 1944 in the said case.

Copy of the Extract Form of the Crime Index has been annexed as Annexure-1. The petitioner has also annexed a

Patna High Court CWJC No.12942 of 2013 (2) dt.20-08-2015 2/2 certificate of Sheetal Prasad Singh, who has been awarded freedom fighter pension.

The petitioner has also annexed certificate of freedom fighter Sheetal Prasad Singh who had certified that the petitioner was underground for two years.

The State in its counter affidavit states that he has recommended the case of he petitioner to the Central Government for needful.

Considering the facts and circumstances of the case, this writ petition is disposed of with a direction to respondent no. 1 to take a decision in the matter within three months from the date of receipt/production of a copy of this order and communicate the decision taken by it to the petitioner forthwith.
