ANJANA MISHRA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 30.6.2014 in Sultanganj P.S. Case No.152/13 for the offences under Sections 147, 148. 149, 323, 307 and 302 of the I.P.C. It is submitted on behalf of the petitioner that even as per the F.I.R., though he was named at the very outset, the petitioner has not been assigned a particular role to play in the present occurrence.

Learned counsel for the informant opposed the prayer of the petitioner and submits that all the accused persons assaulted the father of the informant with lathi, danda, rod and belt resulting in his death.

Patna High Court Cr.Misc. No.40065 of 2014 (3) dt.14-01-2015 2/2 Considering the aforementioned submissions and also the fact that the allegation of assault is general and omnibus against all the accused persons as well as the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., Patna City, Patna, in Sultanganj P.S. Case No.152/13.
