The petitioner is accused in connection with Maharajganj P.S. Case No. 113 of 2019 registered under sections 25(1-b)a, 26 of the Arms Act pending in the Court of A.C.J.M.-V, Siwan.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. Further submission is that petitioner is in custody since 21.04.2019.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that

Patna High Court CR. MISC. No.43398 of 2019(3) dt.24-09-2019 2/2 petitioner has criminal antecedent. He is accused in four other cases. There is recovery of one country-made pistol with live cartridge from the house of the petitioner. Hence, the petitioner does not deserve privilege of bail.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, liberty is granted to the petitioner to renew his prayer for bail after framing of charge.
