The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Dhoraiya P.S. Case no. 69 of 2021 instituted for the offence punishable under Section 302/34 of the Indian Penal Code. It is a case of commission of murder.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. Informant is not the eye witness of the alleged occurrence. In fact, informant's husband death is an accidental.
Learned APP appearing for the State has opposed the prayer of bail and submitted that before his death, deceased has
Patna High Court CR. MISC. No.56835 of 2021(5) dt.21-09-2022 2/2 stated about the complicity of the petitioner to his wife. From perusal of the case diary, it appears that informant in her restatement vide para 8 as well as in para nos. 10 and 11 several witnesses have supported the prosecution story. As per postmortem report, cause of death was due to head injury. Having heard learned counsel for the parties and considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
