The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A and 494 of the Indian Penal Code.
The petitioner and the informant are present in the Court.
The informant who is present, at the outset, submits that the relationship between her and petitioner had soured to an extent that it is not possible to resume the conjugal relationship. The petitioner who is also present submits that he is
Patna High Court CR. MISC. No.46679 of 2022(5) dt.14-07-2023 2/3 works as a laborer in Gujarat and is willing to pay an amount of Rs. 4,000/- by way of monthly maintenance to the informant and the child.
The informant agrees with the submission of the petitioner.
Learned counsel for the informant submits that he will whatsapp the bank account number of the informant on the whatsapp number of the learned counsel for the petitioner and the learned counsel for the petitioner undertakes to forward the same to the petitioner so that the maintenance as agreed commences.
Learned counsel for the informant, on instruction, submits that there is some issue with the informant with regard to her Adhaar Card, it is further submitted that the Adhaar Card of the informant needs to be rectified and which will take a little time but the moment, the bank account is opened, it is submitted that the same will be whatsapped on the number of the learned counsel for the petitioner.
The petitioner who is present submits that he will start paying the amount of Rs. 4,000/- as agreed from 28.07.2023 in the bank account of the petitioner.
Considering the submissions made by the learned

No.46679 of 2022(5) dt.14-07-2023 3/3 counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Patna Complaint Case P.S. Case No. 470 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
In the event, if it takes time in opening the bank account of the informant, the petitioner shall ensure that he has cash ready so that the same is credited in the account of the informant.
However, the informant would be at liberty to file an application seeking cancellation of the anticipatory bail order of the petitioner in the event if he does not deposit the amount, as agreed, in her account for two consecutive months from the date of opening of her bank account.
