1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354(A), 379, 504, 506 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on account of dispute relating to grazing of his maize field by buffalo of petitioner, an altercation took place and petitioner dashed his daughter on the ground and assaulted by fist and leg while Kartik assaulted by an iron rod causing injury on head.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant on account of grazing of field by the buffalo of the
Patna High Court CR. MISC. No.45447 of 2026(2) dt.15-07-2026 2/2 petitioner. It is also submitted that from perusal of the allegation as alleged in the FIR, it would manifest that as far as petitioner is concerned, he is alleged to have dashed the daughter of the informant on ground and assaulted by fist and leg, but then the said allegation is ornamental when specific allegation of assaulting the victim is against Kartik by an iron rod causing injury on head.
5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Madhepura (Ghailadh O.P.) P.S. Case No. 518 of 2024 subject to the conditions as laid down under Section 482 (2) of BNSS.
