This writ petition has been filed by the petitioner for issuance of writ in the nature of mandamus or any other appropriate writ order or direction for commanding the respondents to pay the death-cum-retirement benefit to the petitioner in view of the demise of her husband on 29.03.2019, an employee of Patna Municipal Corporation and also to release family pension in favour of the petitioner.
Patna High Court CWJC No.14233 of 2019 dt.11-02-2021 2/2 It is submitted on behalf of the petitioner that during pendency of the case, petitioner came to know about the dismissal of her husband vide order dated 19.06.2017 through counter affidavit filed on behalf of respondent. In view of the aforesaid fact, petitioner seeks to withdraw this writ petition to file fresh writ application challenging the order of dismissal dated 19.06.2017 of her husband.
Counsel for the respondent has no objection.
With consent of the parties, this writ petition is disposed of with a liberty to the petitioner to file fresh writ application challenging the order of dismissal dated 19.06.2017 of her husband.
