2. The petitioner is apprehending his arrest in connection with Kateya P.S. Case No. 76 of 2025, F.I.R. dated 16.02.2025 registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109(1), 303(2), 351(2) and 3(5) of the BNS.

3. Allegation against the petitioner is that he along with other co-accused person attacked on the head of the informant with rod with intention to kill the informant and she caused bleeding injury in her head.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has been falsely

Patna High Court CR. MISC. No.44715 of 2025(2) dt.23-07-2025 2/2 implicated in the present case. Although, the petitioner is named in the F.I.R. but there is no specific allegation against the petitioner in the F.I.R.

5. Learned APP for the State, on the other hand, opposed the prayer for anticipatory bail of the petitioner and submits that from perusal of the F.I.R. it appears that the petitioner is first accused in the present case and he has entered into the house of the informant along with other co-accused person and apart from that similarly situated co-accused person has been granted regular bail by a Coordinate Bench of this Hon'ble Court.

6. Considering the aforesaid facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Kateya P.S. Case No. 76 of 2025 pending in the Court of learned Principal Sessions Judge, Gopalganj.

7. Prayer is refused.
