JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-08-2023 Heard Mr. Yogesh Chandra Verma, the learned Senior counsel for the petitioner as well as Mr. Shailendra Kumar, the learned Additional Public Prosecutor for the State.

2. The petitioner apprehends his arrest in connection with Kundwa Chainpur P.S. Case No. 72 of 2023, registered for offence punishable under sections 392 and 411 of the Indian Penal Code and sections 25 (1-b)a/35 of the Arms Act.

3. As per FIR, on 20.04.2023 at about 7:00 P.M., the informant along with his son was returning to his house after closing his shop and when he reached at Chainpur Railway crossing, three accused persons stopped his motor cycle, abused and also snatched Rs. 2,500/-, bank passbook etc. from him. On chase, the accused persons succeeded to flee

Patna High Court CR. MISC. No.50090 of 2023(2) dt.11-08-2023 2/2 away after leaving their motor cycle and looted cash as well as articles. One country-made pistol was also recovered from there.

4. Mr. Verma, the learned Senior counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. Nothing was recovered from his possession and there is nothing against him at all except confessional statement of co-accused.

5. On the other hand, Mr. Shailendra Kumar, the learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Kundwa Chainpur P.S. Case No. 72 of 2023, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) Mahesh/- U T
