The petitioner seeks bail in Barh P.S. Case No. 195 of 2019, instituted for the offence under Section(s) 457, 380 and 414/34 of Indian Penal Code.

It is alleged in the written report that theft was committed in the house of informant. Two Mobile phones, Rs.80,000/- cash, cloth and jewelry as mentioned in the written report have been stolen. The informant along with his family had gone out of village in course of treatment of his brother at Patna. On 22.4.2019 when he returned, he found the lock broken. On enquiry Mohalla people told the informant that petitioner along with his friend has committed burglary. The informant went to the house of petitioner. On search, the stolen

Counsel for the petitioner submits that seizure list has been prepared which is part of the First Information Report which shows that recovery has been made from Hanuman Mandir situated near NH.31. There is no signature of the petitioner in the seizure list.

Petitioner is in custody since 23.4.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Barh, Distt. Patna, in connection with Barh P.S. Case No. 195 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
