The petitioner seeks bail in connection with Amarpur P. S. Case No.112 of 2021, instituted for the offences under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 06.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the allegation is of looting of Rs.50,000/-, a laptop and a mobile from the possession of the informant by four unknown criminals.

It is submitted that the F.I.R. is against unknown and the name of the petitioner transpired in the confessional

Parade and nothing has been recovered from the possession of the petitioner. The learned counsel further submits that co-accused Raja Kumar @ Raja Kumar Sah has been granted bail by order dated 01.02.2022 in Cr. Misc. No.45292 of 2021 and Md. Kalim has been granted bail by order dated 01.02.2022 in Cr. Misc. No.47723 of 2021. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and co-accused persons have been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Amarpur P. S. Case No.112 of 2021.

The application stands allowed.
