Patna High Court CWJC No.2544 of 2021(2) dt.23-11-2021 2/3 form self-help institutions to curb poverty in terms of guidelines under the Support Programme for Urban Reforms (SPUR). The petitioner is seeking direction to the respondents to pay the outstanding dues to the tune of Rs. 25,61,405 /- with interest against final bill submitted for execution of the aforesaid work. From the pleadings and the annexures brought on record, it appears that the petitioner has been asked by the concerned respondents to submit certain documents/evidence in support of his claim.
Mr. Avinash Kumar, learned counsel appearing on behalf of the petitioner, has submitted that after filing of this writ application, the petitioner has received another communication dated 19.01.2021, similar to the one available at Annexure- 11 to the writ application, requiring the petitioner to submit certain documents in support of execution of work. On the basis of instructions which he has received, he has submitted that the petitioner has submitted documents in response to the said communication dated 29.01.2021 before the Project Officer-cum-Additional Director, Urban Development and Housing Department, Government of Bihar.
It will be open for the petitioner to pursue his remedy before the appropriate authority.
Patna High Court CWJC No.2544 of 2021(2) dt.23-11-2021 3/3 We are not inclined to entertain petitioner's claim in the facts and circumstances of the case and a proceeding under Article 226 of the Constitution of India.
This application stands disposed of with the aforesaid observation.
