The petitioners apprehend arrest in connection with Jokihat P.S. Case No. 114 of 2017 registered under Sections 341, 363, 366/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that as a matter of fact the daughter of the informant had love affair with petitioner no. 1 and she herself left the house with her sweet will and performed Nikah. In her statement under section 164 Cr. P.C. (Annexure-2) has clearly stated about the love affair and deposed that she wants to go to her in-laws place. On medical examination, the victim was assessed to
Patna High Court Cr.Misc. No.33569 of 2017 (2) dt.20-07-2017 be of 17-19 years of age and as such she was released in favour of the petitioner as per Jimmenama (Annexure-3). Petitioners have no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate II, Araria in connection with Jokihat P.S. Case No. 114 of 2017 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
