JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 24.7.2014 in a case registered for the offences punishable under Section 364 of the Indian Penal Code.
The accusation is of kidnapping the son of the informant.
It is submitted by the learned counsel for the petitioner that the victim in 164 Cr.P.C. statement has not named this petitioner wereas others have been granted bail vide Cr. Misc. Nos. 12464 and 7185 of 2014. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.40773 of 2014 (3) dt.20-01-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Gobindpur P.S. Case No. 113 of 2012.
