JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-01-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 44 of 2017 for the offences punishable under sections 341, 323, 307, 379, 385, 34, 504 and 506 of the I.P.C.
Allegedly, due to non fulfillment of demand of ransom of Rs. 10,000/- per month the petitioner assaulted the informant with iron rod on his head causing head injury and bleeding. Submission is of false implication and that the petitioner is being implicated in several cases due to land dispute, no such occurrence has taken place, there is case and counter case, opinion of injury has been kept reserved, on the person of the
Patna High Court Cr.Misc. No.50604 of 2017 (3) dt.15-01-2018 2/2 informant only two lacerated wounds have been found and as such the petitioner deserves sympathetic consideration. The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.
In the facts and circumstances stated above, considering the allegation attributed against the petitioner and further that on the vital part of the informant injury has been found and as such I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of C.J.M. Muzaffarpur.
