The petitioner apprehends his arrest in Goreyakothi P.S. Case No.98 of 2018 registered under Sections 363, 366(A) and 34 of the Indian Penal Code.

The informant, brother of the victim, disclosed that his mother searched his minor sister inside the house but she could not be traced out during the search. The informant went to the house of Vipin Kumar, the neighbour of the informant but Vipin Kumar was also not found inside his house. The informant suspected that Vipin Kumar and his family members kidnapped his minor sister.

The learned counsel for the petitioner submits that the petitioner is the neighbour of the informant. The petitioner never kidnapped the victim rather victim came to the petitioner and

Patna High Court CR. MISC. No.43899 of 2019(2) dt.17-07-2019 2/2 solemnised marriage in a temple out of her free will. The victim and the petitioner went to Delhi. Victim made her statement under Section 164 Cr.P.C. and she denied the factum of her kidnapping. She disclosed that she was loving with the petitioner and they solemnised marriage in a Temple and went to Delhi. She wanted to live with her husband. The victim disclosed her age to be 21 years. The Court assessed the age of the victim to be 18 years.

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan or Successor Court, Siwan in connection with Goreyakothi P.S. Case No.98 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
