1. The present petition has been filed seeking modification of the order dated 01.06.2021, passed in Criminal Miscellaneous No.39081 of 2020, to the extent of extension of the time granted to the petitioner to surrender before the learned Court of Exclusive Special Judge Excise, Bettiah, West Champaran in connection with Manjhaulia P.S. Case No.501 of 2020, for the purposes of availing the privilege of anticipatory bail.
2. The learned counsel for the petitioner has submitted that on account of illness and subsequent death of the uncle of the petitioner, the petitioner could not surrender before the learned Trial Court in time, however, the petitioner undertakes
Patna High Court CR. MISC. No.58416 of 2023(2) dt.01-09-2023 2/2 to surrender, within a period of two weeks from today, before the learned Trial Court in order to avail the privilege of anticipatory bail, failing which, it is submitted that the petitioner shall surrender before the learned Trial Court and apply for regular bail.
3. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in the present case, I deem it fit and proper to extend the time granted to the petitioner to surrender before the learned Trial Court and avail the privilege of anticipatory bail, by a further period of two weeks from today.
4. The present petition stands disposed off with the aforesaid modification in the order dated 01.06.2021, passed by this Court in Criminal Miscellaneous No.39081 of 2020. (Mohit Kumar Shah, J) sonal/- U T
