JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Petitioner being Block Teacher-cum-Secretary of Madhurapur School is languishing in custody since 16.07.2014 in a case registered for the offences punishable under Sections 406, 409, 419, 420, 34 of the I.P.C. It is alleged that in the financial year 201112, for the construction of the school buildings a sum of Rs. 8,00,000/- was withdrawn from the construction fund of the school building by the petitioner and Headmaster of the school. It is submitted by learned counsel for the petitioner that petitioner subsequently deposited Rs.
2,10,000/- in the concerned account. Learned counsel for the petitioner further submits that petitioner will deposit Rs. 1,00,000/- before learned Court below within a period of four months, which will be invested in some fixed deposit scheme in connection with the present case which will be subject to the
Patna High Court Cr.Misc. No.41329 of 2014 (3) dt.23-01-2015 2/2 result of the case.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahna at Motihari in connection with Phenhara P.S. Case No. 11 of 2014.
The bail bonds of the petitioner will be accepted provisionally for a period of four months which will be finally accepted on deposit of the aforesaid amount. (Dinesh Kumar Singh, J) Shageer/- U T
