The petitioner apprehends his arrest in a case registered for the offence punishable u/s 399, 402 of the IPC and 25(1-b)a, 26, 35 of the Arms Act.

As per the prosecution case, five persons were apprehended by the police and from their possession, pistols, live cartridges, etc. were recovered and they disclosed that the petitioner fled away from the spot.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to grudge. Petitioner has neither been apprehended from the spot nor any incriminating article has been recovered from his conscious
Patna High Court CR. MISC. No.51837 of 2024(2) dt.04-09-2024 2/2 physical possession. His name transpired in this case only on the basis of statement of the apprehended co-accused. There is no allegation against the petitioner and he has two criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Jamui P.S. Case No.111/2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. 7.
However, learned Court below is directed to verify the criminal antecedent of the petitioner before accepting the bail bond and if it is found that the petitioner has more than two criminal antecedent, his bail bonds shall not be accepted. (Anjani Kumar Sharan, J) pallavi/- U T
