The petitioner has preferred this application for grant of regular bail in a case registered under sections 401 and 414 of the Indian Penal Code.

As per the prosecution case, on information having been received about accused persons having gathered to sell a stolen motorcycle, a raid was conducted and from the possession of the five accused persons including the petitioner herein, one stolen motorcycle was recovered. Further, it is stated that on information disclosed by them another stolen motorcycle was recovered from the possession of Manish Kumar. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.57552 of 2021(2) dt.08-04-2022 2/2 that the petitioner has been falsely implicated in the case. Contrary to the allegations, no incriminating article has been recovered from his possession. He is in custody since 18.3.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for 1 year and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Town P.S. Case no.196 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
