JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 29-08-2017 At the very outset, learned counsel for the petitioners submits that the petitioner no.2, above named, has already been arrested by the police in the case and seeks permission to withdraw this application in respect of the petitioner no.2, above named.

Permission is accorded.

This application in respect of the petitioner no.2, above named, is dismissed as withdrawn.

Now, only the prayer of the petitioner no.1, above named, for grant of anticipatory bail is being considered. Heard.

Patna High Court Cr.Misc. No.34946 of 2017 (3) dt.29-08-2017 2/2 The petitioner no.1, above named, apprehends his arrest in connection with Kadamkuan P.S. Case No.193 of 2017/Special Case No.66 of 2017 registered under Sections 20 and 22 of the N.D.P.S. Act, pending in the court of the Sessions Judge-cumSpecial Judge, Patna. The accusation is of recovery of 24 grams Ganja, kept in 8 Purias, from the Gumti of the petitioner no.1, above named, and the petitioner no.1, above named, succeeded to flee away from there.

Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner no.1, above named.

Accordingly, the prayer of the petitioner no.1, above named, for grant of anticipatory bail stands rejected. However, the petitioner no.1, above named, is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
