The petitioner apprehends his arrest in connection with Rosera P.S. Case no. 173 of 2008, registered under Sections 302/34 and 120B of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that while on the basis of fardbeyan of Phulkant Chaudhary, Rosera P.S. Case no. 173 of 2008, under Sections 302/34 and 120B of the Indian Penal Code and Section 27 of the Arms Act was instituted on 25.11.2008 against 13 accused and three unknown, but on investigation, while Final Form was submitted against this petitioner and one Hari Om Lal on 31.03.2012, but during the trail, petitioner and Hari Om Lal
Patna High Court CR. MISC. No.43225 of 2019(2) dt.12-07-2019 2/2 were summoned on 30.11.2018 under Section 319 Cr.P.C. Further submission is that Hari Om Lal has been granted anticipatory bail on 29.01.2019 vide A.B.P. No.2880 of 2018 passed by the learned Sessions Judge, Samastipur, while the prayer of anticipatory bail of the petitioner was refused by the Addl. Sessions Judge-II, Rosera on 22.06.2019 vide A.B.P. No. 640 of 2019. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. District and Sessions Judge, Rosera in connection with Rosera P.S. Case No. 173 of 2008, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
