JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-08-2023 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Veer Kunwar Singh University (hereinafter referred to as the 'University').

2. The petitioner in the present case is seeking a writ in the nature of Writ of Mandamus commanding the respondent University to provide her the original Graduation certificate of passing her B.Sc. Physics (Honors) Examination conducted by the University for the Sessions 2016-19.

3. It is the specific case of the petitioner that she was a regular student of B.Sc. Physics (Honors) of Sri Mouni Baba Yamuna Das Lakhrajo Devi Mahila College, Bikramganj, Rohtas during

Patna High Court CWJC No.10169 of 2023(3) dt.07-08-2023 2/2 academic sessions 2016-19 and she was allowed to appear in B.Sc. Physics (Honors) Examination conducted by the University which she has successfully passed. The University has issued her marksheets also.

Learned counsel for the petitioner as well as learned counsel for the University jointly submit to this Court that this case would be covered by the judgment of this Court rendered in CWJC No. 18035 of 2022 and CWJC No. 8065 of 2023 (Bintesh Kumar Rai Vs. The State of Bihar and Ors), hence, this writ application may be disposed of in similar terms.

5. In CWJC No. 8065 of 2023, this Court having noticed the similar facts, issued the following directions:- "In the facts of the present case as noticed above, this Court directs respondent nos. 4 and 5 to issue original marksheet and degree certificate etc. to the petitioner within a period of one month from the date of receipt/communication of a copy of this order."

6. There being no dispute on facts in the present case, this Court is disposing of the present writ application in terms of the judgment/order dated 13.07.2023 passed by this Court in CWJC No. 8065 of 2023.
