The petitioner apprehends his arrest in Khagaria (Gangour) P.S. Case No. 158 of 2017 registered for the offences punishable under Sections 366 and 34 of the Indian Penal Code. The informant Mantun Singh made allegation that the petitioner and others kidnapped his daughter. Learned counsel for the petitioner submits that the petitioner happens to be younger brother of Nandan Singh. The victim made her statement under Section 164 of the Code of Criminal Procedure and she disclosed that she voluntarily went along with Nandan Singh but her father falsely implicated the entire family members of Nandan Singh. The victim is a major girl.

Patna High Court Cr.Misc. No.46528 of 2017 (2) dt.22-09-2017 Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in Khagaria (Gangour) P.S. Case No. 158 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
