JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Babu Barhi P.S. Case No. 159 of 2017 dated 07.08.2017 instituted for the offences under Sections 341, 323, 504, 420 of the Indian Penal Code. The petitioner is said to have misused his position as a Secretary of Madarsa Ahya-ul-Uloom.

The learned counsel for the petitioner has submitted that no such offence as alleged in the F.I.R has been committed by him. In fact, the accusation has been levelled by one of the members of the Education Committee

Patna High Court Cr.Misc. No.57658 of 2018(3) dt.11-12-2018 2/2 of the Madarsa of which the petitioner was an ex-member. He has further submitted that the dispute inter-se is between the two factions of the Madarsa Committee and the petitioner has unnecessarily been made an scape goat in the matter.

Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today before the learned Court below, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, II, Madhubani in connection with Babu Barhi P.S. Case No. 159 of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
