The petitioner seeks bail in connection with Phulwariya P.S. Case No. 432 of 2021 instituted for the offence under Section 387 of the Indian Penal Code.

The prosecution case, in brief, is that on 11.11.2021 at about 9:28 A.M., the informant, a grocery shop owner of Bathuwa Market, received a call on his mobile demanding Rs. 20 lakh as ransom within two days, threatening dire consequences on failure, leading to registration of the present FIR.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.11.2024. Petitioner
Patna High Court CR. MISC. No.48460 of 2025(4) dt.15-10-2025 2/3 bears twenty-four criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has surfaced during investigation. Learned counsel for the petitioner pertinently submits that on the alleged date of occurrence, petitioner was in custody. Petitioner has no concern with the mobile number used for demanding ransom. 6.
Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case and period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Phulwariya P.S. Case No. 432 of 2021, subject to the following conditions:
(I) One of the bailors shall be own/close member of the family of the petitioner.
