JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-07-2019 The present writ petition has been filed to direct the respondents to remove the encroachment from the public road situated at Mohalla Mirzapur, P.S. Town, District Darbhanga. Having regard to the nature of prayer made by the learned counsel for the petitioner in the present case, I deem it fit and proper to grant liberty to the petitioner to approach the Circle Officer, Sadar, Darbhanga by filing an appropriate petition, which shall be considered by the Circle Officer, Sadar, Darbhanga in accordance with law, i.e. under the provisions of the Bihar Public Land Encroachment Act, 1956 and appropriate action shall be taken in accordance with law. The writ petition stands disposed of on the aforesaid terms.
