1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Saharghat P.S. Case No. 27 of 2023 dated 04.03.2023 registered for the offence(s) punishable under Section(s) 272, 273, 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

3. The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to the recovery of 180 litres of illicit Nepali Saufi liquor from a tempo and 90 litres of same type of liquor from a motorcycle and petitioner is stated to have been caught with the alleged liquor kept on the said motorcycle but the petitioner has no concern with both the said vehicles and he has been falsely

Patna High Court CR. MISC. No.47082 of 2023(2) dt.31-07-2023 2/2 roped in this case. Further submissions are that the petitioner has fair and clean antecedent and he has been languishing in jail since 05.03.2023 and against him, the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's fair and clean antecedent and completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Saharghat P.S. Case No. 27 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned with condition that:- Both the bailors shall be local residents of the trial court having sufficient immovable property to the satisfaction of the trial court and further the petitioner shall not leave the territory of the India without the permission of the trial court and deposit his passport in the trial court, if he possess.
