2. The petitioner apprehends his arrest in connection with Itarhi P.S. case No. 46 of 2024 registered under Sections 147, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.
3. As per F.I.R., this petitioner is alleged to have assaulted on head of the husband of informant.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on suspicion. Further submission is that though there is allegation of assault, but the doctor has found the injury simple in nature. Similarly situated co-accused Rangu Yadav @ Ranjeet Kumar Singh has already been granted bail by this Court vide order dated 24.07.2024
Patna High Court CR. MISC. No.51354 of 2024(3) dt.13-09-2024 2/2 passed in Cr. Misc. No. 45799 of 2024. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail by contending that petitioner is named in the First Information Report with the allegation of assault.
6. Having considered the facts and circumstances of the case, nature of injury and similarly situated co-accused has already been granted bail, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Court No. 11, Buxar in connection with Itarhi P.S. case No. 46 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
