2. The petitioner seeks bail in connection with a case registered for the offence punishable under Sections 341, 323, 379, 376, 34 of the IPC.
3. The allegation levelled against the petitioner is that he used to threaten the informant to make her naked photographs viral on social media. It is further alleged that on 24.08.2021, the petitioner along with other co-accused persons assaulted upon the informant's side brutally.
4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. No such occurrence as alleged has ever taken place. He has been falsely implicated in this case due to ulterior
Patna High Court CR. MISC. No.53734 of 2024(2) dt.14-08-2024 2/2 motive. The allegation levelled against the petitioner is totally false and based on concocted facts. There is case and counter case between the parties. It is further submitted that earlier vide order dated 10.04.2024 in Cr. Misc. No. 79809 of 2023, the prayer for bail application of the petitioner was rejected by this Court with an observation to renew his prayer for bail after framing of charges. He further submits that now charge has been framed against the petitioner. Petitioner has one criminal antecedent and he is in custody since 25.09.2023.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the period of custody as well as the fact that charge has already been framed against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Bela P.S. Case no. 180 of 2021.
