JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kaluahi P.S. Case No. 92 of 2018 for the offenses under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The allegation against this petitioner is that he was involved in loot of Rs. 4500/- from the pocket of the informant and Samsung J2 Mobile and Passion Pro Motorcycle. The petitioner was not named in the FIR. His name was disclosed by co-accused Ajeet Kumar Das. The petitioner is in custody since 17.02.2019.

Considering the fact that the petitioner was not named in the FIR and he is in custody since 17.1.2019, the

Patna High Court CR. MISC. No.43425 of 2019(2) dt.16-07-2019 2/2 Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Shri M. Dubey, J.M. 1st Class, Madhubani in connection with Kaluahi P.S. Case No. 92 of 2018.
