JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 This is an application for grant of anticipatory bail in connection with Gandhi Maidan P.S. Case No. 09 of 2019, G.R. No. 232 of 2019, disclosing offences under Sections 406 and 420 of IPC.

Prosecution story as per the written report filed by the informant is that one Dhiraj Kumar Singh was working as Accountant in his company M/s Modem Ad Agency Pvt. Ltd. and he suspects that he withdrew altogether eighty lakhs rupees from the company and deposited the same in the accounts of his wife, namely, Nitu Singh, Diwakar Lal and they have withdrew the said amount from their bank by using forged signatures of the informant and when the said information was given by the

Patna High Court CR. MISC. No.43066 of 2019(2) dt.12-07-2019 2/3 bank, then Dhiraj Kumar Singh and his wife returned about Rs.19,00,052/- after withdrawing the maturity amount of their fixed deposit, but up till now Rs.61,00,000/- is still outstanding with the accused Dhiraj Kumar Singh.

Submission of the learned counsel for the petitioner is that even according to the F.I.R. the allegation is against Dhiraj Kumar Singh. F.I.R. disclosed that some amount has been deposited in the account of petitioner. He has further submitted that petitioner is ready to co-operate in the investigation and to appear as and when required.

Heard learned A.P.P. also.

Having heard both sides, considering the above submissions, let the petitioner, above named, surrender before the court below by 18.07.2019, the learned court below shall be released him on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Judge-cum- A.C.J.M.- XVIII, Patna, in connection with Gandhi Maidan P.S. Case No. 09 of 2019, G.R. No. 232 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate the police and appear as and when required, otherwise his bail bonds shall be cancelled.
