The petitioner has put to challenge an order of SubDivisional Officer, Danapur-cum-Licensing Authority, whereby the petitioner's licence to run a fair price shop under Bihar Targeted Public Distribution (Control) Order, 2016, has been cancelled.

Patna High Court CWJC No.2271 of 2021(2) dt.17-01-2022 2/2 Admittedly, the petitioner has not preferred appeal against the impugned order of cancellation of licence dated 23.09.2020.

Considering the facts and circumstances, this application is disposed of with a liberty to the petitioner to prefer appeal against the order of the Licensing Authority. If any such appeal is preferred within four weeks from today with an application seeking condonation of delay, the Appellate Authority will be required to consider the question of delay in filing appeal, keeping in mind the fact that the petitioner was pursuing his remedy before this court by filing the present writ application. The Appellate Authority shall, thereafter, decide the petitioner's appeal on merits within the period prescribed under Bihar Targeted Public Distribution (Control) Order, 2016.
