====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner apprehends his arrest in connection with Vaishali P.S. Case No. 229 of 2016 registered for the offences punishable under Sections 364, 366, 366(A)/34 of the Indian Penal Code.

Allegedly, the petitioner kidnapped the daughter, aged 16 years, of the informant. During investigation the statement of the victim was recorded under Section 164 Cr.P.C. wherein she has stated her age 20 years and the learned Magistrate also assessed her age 20 years. She has stated that she went away with the petitioner at her own and she performed marriage in Hajipur Court with the petitioner and thereafter, went away to Haryana and lived there. She has stated that there is no fault on the part of the petitioner and she went away herself.

Patna High Court Cr.Misc. No.35143 of 2017 (2) dt.10-08-2017 In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P. S. Case No. 229 of 2016, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
