1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of one antecedent and has been falsely implicated in the instant case by the informant. It is next submitted that the informant alleges that the accused persons including the petitioner came and Mridula Devi assaulted the informant. Thereafter, the accused
Patna High Court CR. MISC. No.49030 of 2024(2) dt.12-07-2024 2/3 persons assaulted his family members and Bogaiya Paswan assaulted him by lathi.
4. The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that specific allegation of assault is against Mridula Devi and Bogaiya Paswan. It is further submitted that maternal nephew of the informant had made an objectionable video of the daughter of the petitioner and made it viral, which was objected by the wife of the petitioner and it was for this reason that the informant and other had assaulted the wie of the petitioner for which Dhanarua P. S. Case No. 763 of 2023 was instituted. It is further submitted that no specific allegation of assault is alleged against the petitioner.
5. Learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, abovenamed, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed

No.49030 of 2024(2) dt.12-07-2024 3/3 to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar Rajak, the learned J. M., Ist Class, Masaurhi, Patna in connection with Dhanarua P. S. Case No.762 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
