JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 05-10-2015 A PDS shop was allowed to Hardiyan PACS through its President Shri Rama Shankar Shukla for the village Amwan, Gram Panchayat Raj Amwan, Block Bhorey in the district of Gopalganj. As the President of the PACS has to remain outside with respect to his personal work, the PACS submitted a resolution to the Block Supply Officer, Bhorey authorizing the petitioner to handle the PDS shop and the finance related to it. The petitioner has raised a grievance that the licensing authority stopped the allotment for the fair price shop without issuing even a formal order/letter causing personal loss to him. The petitioner in paragraph 17 of his rejoinder to the counter affidavit states that he has deposited a sum of Rs.32,970/- by different pay-in-slips in the account of BSFC, Gopalganj for lifting the allotted quota but he was unaware for quite some time

Patna High Court CWJC No.18245 of 2013 (3) dt.05-10-2015 that the fair price shop has been tagged with another shop. Learned State counsel submits that the licensee has a new President who is taking care of the dealership. As the petitioner now seeks refund of the amount which he has deposited with the BSFC, Gopalganj, this writ application is disposed of with an observation that the licensing authority would look into the grievance of the petitioner and would issue necessary direction with respect to the amount deposited by the petitioner within a period of two months from the date of receipt of such representation.
