The petitioners are apprehending their arrest in connection with Chautham P.S. Case No. 95 of 2018 for the offence under Sections 341, 323, 427, 386, 379, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act. After some arguments, the learned counsel for the petitioners seeks permission to withdraw the present application for grant of anticipatory bail on behalf of petitioner no.1. However, withdrawal of the anticipatory bail application will not cause prejudice to the petitioner no.1 and in the event, the petitioner no.1 surrender before the Court below and prays for

Patna High Court Cr.Misc. No.53980 of 2018(3) dt.12-12-2018 2/2 regular bail, the Court below is hereby directed to dispose of the application for regular bail of the petitioner on the same day in accordance with law without being prejudice by this order. Considering the case of petitioner No. 2 to 4, The court is noticing that petitioners and informant are Gotiya and there is dispute in connection with Parwal Crop, let the petitioners above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Court of Learned Chief Judicial Magistrate, Khagaria in connection with Chautham P.S. Case No. 95 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C.
